Terms of Service

1. Acceptance

By creating an account or using any of the Growing Green apps (the "Service"), you agree to these Terms of Service (the "Terms"). The Service is operated by Mana Softworks LLC ("we," "us," "our"). If you do not agree, do not use the Service.

2. Service description

Growing Green provides three connected applications:

• Farmer App (Admin) — farm management dashboard for owners and operators
• Market App — customer-facing marketplace to buy directly from farms
• Worker App — employee field app for clock-in, tasks, and pay stubs

3. Eligibility

You must be at least 18 years old to subscribe. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Account

• You are responsible for all activity under your account.
• Keep your password secure. Notify us promptly of any unauthorized use.
• One account per farm operation.
• Provide accurate information; keep it current.

5. Subscription terms

Price

The Farmer App is $24.99 per month, billed monthly in U.S. dollars. The Market and Worker apps are free.

Free trial

New subscribers receive a 30-day free trial of the Farmer App. The trial begins when you start your subscription.

Auto-renewal

Your subscription automatically renews each month until you cancel. We'll charge the payment method on file at the start of each billing cycle.

How to cancel

Cancel anytime from Settings → Subscription inside the Farmer App. Cancellation takes effect at the end of your current billing cycle. You'll keep access until that date.

Refunds

Subscription fees are non-refundable for partial months. If you cancel mid-cycle, you keep access until the cycle ends and are not charged for the next cycle.

App stores & billing

The Growing Green apps are also distributed through the Google Play Store and the Apple App Store. Where a store requires it, subscription purchases are processed through that store's billing or its approved external-billing program; otherwise the Farmer App subscription is billed through our website. Apple and Google are not parties to these Terms and are not responsible for the Service or its support. Your use of an app obtained from a store is also subject to that store's own terms.

6. Marketplace and royalties

• We charge a 4% royalty on Stripe-processed marketplace sales.
• The royalty is capped at $400 per month per farm. Once you reach the cap, every additional sale that month is 0%.
• Cash sales tracked in the app are not subject to the royalty. Only sales processed through Stripe count.
• The 4% rate applies equally to all sales channels — direct-to-consumer, in-person, and online — when processed through Stripe.
• Marketplace transactions use Stripe Connect in the direct-charges model. You are the merchant of record; Growing Green is a software platform.
• Payouts go directly to the Stripe account you connect during onboarding, on Stripe's standard payout schedule.

7. Acceptable use

You agree not to:

• Scrape, mirror, or otherwise duplicate the Service
• Resell access to the Service
• Use the Service for illegal activity
• Bulk-create accounts or impersonate others
• Reverse-engineer, decompile, or attempt to extract source code
• Interfere with the Service's operation or other users' use of it

8. Content ownership

• You own all the farm data you enter. Always. Forever.
• You grant us a limited, non-exclusive, royalty-free license to host, store, display, and process your data solely to provide the Service to you.
• We may use anonymized, aggregated data (no name or email) to improve the Service and understand usage trends.

9. Intellectual property

The Growing Green name, the sprout logo, the apps, the source code, and all related materials are the property of Mana Softworks LLC and are protected by copyright and trademark law. You receive a personal, non-transferable license to use the apps under these Terms — nothing more.

10. Termination

• By you — cancel anytime from inside the app.
• By us — we may suspend or terminate your account for material breach of these Terms (e.g., fraud, abuse, illegal use). For breach, we'll give notice and a chance to cure where reasonable.

On termination, you can export your data for up to 30 days before it is purged from active storage.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific farming or financial outcome from using the Service.

12. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Mana Softworks LLC and its officers, employees, and agents from any claim, loss, or expense arising out of (a) your use of the Service, (b) your content, or (c) your breach of these Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any dispute arising out of these Terms shall be brought exclusively in the state or federal courts located in Charleston County, South Carolina, and you consent to personal jurisdiction there.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email and with an in-app banner before they take effect. Continued use of the Service after the effective date constitutes acceptance.
